ALICANTE MAGISTRATES' COURT CONFIRMS THAT BTA DRAUDIMAS AND CAM BANK ARE LIABLE AND MUST REFUND DEPOSITS TO ROYAL DREAMS OF ALBUIDETE' PURCHASERS
Things are getting better to Royal Dream of Albuidete buyers, who can finally see a light at the end of the tunnel and forget this nightmare.
The 5th Department of the Alicante Magistrates Court has rejected the defendants appeal and sentence BTA and CAM Bank to refund deposits, plus legal interest and defense cost to our customer, who bought a property to Solera El Trampolin in the resort "Royal Dreams of Albudeite".
This proves that our customers were right when they didn't give up and decided to follow our advice about suing bank and insurance company. We are organizing a few class action, so if you are in the same position that our customers, you are still in time to join it.

GM LEGAL EXPERTS WINS THE APPEAL AND CONVINCES  MAGISTRATES' COURT TO CHANGE CRITERIA
We have successfully enforced a SGR's bank guarantee for El Pinet in Valencia Court. Major legal issue for this case was that our customer voted in favor of creditors' agreement, so Bank was claiming that same release and payment schedule agreed with developer (San Jose Inversiones y Proyectos Urbanísticos) should apply to bank guarantee. 
Valencia First Instance Court rejected banks' defense, but Bank appealed. The 6th department of the Valencia Magistrates' Court took over the appeal, and although its initial criteria was the release and extension agreed with developer was applicable to bank guarantee, we could convince them this time to move forward and rule that bank guarantee was enforceable for the whole amount, plus interest, no matter whether purchaser voted in favor of the creditors' agreement. SAN JOSE INVERSIONES Y PROYECTOS URBANÍSTICOS SA GOES INTO LIQUIDATION
Later in November 2014 San Jose Inversiones y Proyectos Urbanísticos requested the liquidation of the company, claiming that there are unable to meet the payment scheduled  agreed on the meeting of creditors (80% on deposits, within 5 years: 10% on 2015 and 70% on 2016).
The Court has accepted their request, so the company has gone into liquidation, and creditors' agreement is not longer valid.
As you probably already know, San Jose did sign generic bank guarantees with different banks to cover deposits paid for most of their developments (El Pinet, Albatera Golf...). Now that San Jose is being liquidated, our opinion is that the only realistic way to get deposits refunded is to sue Banks. We are aware that many buyers were reluctant to do it because they accepted San Jose's payment proposal. But that's not longer a problem, so we encourage purchasers to seek for advice.
