DEPOSITS FOR OFF PLAN PROPERTIES PAID BEFORE OR AFTER JANUARY 2016. IS THERE ANY DIFFERENCE?

Since 1968, Spanish developers selling off plan properties must give to purchasers an individual bank guarantee to cover the whole deposit payment plus legal interest, which must be provided by registered banks or insurance companies.

To all deposits paid before January 2016, applicable law is 57/68 Act, which is a mandatory law that establishes that deposits must be held by developers into a bank account called "special". Banks must control that money's withdrawals from this account are just being used for building purposes, making sure that the individual bank guarantee it’s issued for all those buyers who made those payments. In addition, the Act declares that purchasers' right are unwaivable, which means that buyers are covered by this law although isn’t mentioned on purchase contract.

Desde 1968, los promotores españoles que vendan viviendas en construcción deben hacer entrega a los compradores de una garantía emitida por una entidad bancaria o aseguradora que cubra la devolución de la totalidad de las cantidades entregadas a cuenta del precio, más los intereses legales.
La ley que resulta aplicable a todas las entregas a cuenta realizadas antes de enero de 2016, es la Ley 57/68,  de 27 de julio, una norma de carácter imperativo que establece que los promotores deben ingresar los pagos a cuenta en una cuenta bancaria calificada como "especial". Los bancos depositarios están obligados a controlar que de las cantidades ingresadas en esas cuentas el promotor únicamente disponga para fines relacionados con la construcción, asegurándose de que la garantía bancaria individual se emita para todos los compradores que realizaron esos pagos. SEVERAL JUDGEMENTS SENTENCE SABADELL BANK TO REFUND DEPOSITS TO ROYAL DREAM OF ALBUDEITE'S BUYERS (SOLERA EL TRAMPOLIN)

Different Courts from Alicante and Valencia have sentenced Banco Sabadell (former CAM Bank) to refund deposits plus interest to buyers represented by GM LEGAL EXPERTS head lawyer, Guadalupe Sánchez.
Courts found that plaintiffs proved that CAM Bank was the one appointed by the builder, Solera El Trampolin, to get deposits from purchasers in Albudeite, given that internal bank's reports show that CAM had knowledge of the resort' details, so any deposit made into that account should have been guaranteed under the provisions of the 57/68 Act.
