Another case won! Spanish First Instance Court from Torrevieja has just issued the sentence that confirms that Bankia's generic bank guarantee for Golden Sun / Bahía de Pulpí is enforceable, no matter if individual bank guarantees weren't given or if money wasn't paid into the developers' accounts opened in Bankia.
Sentence confirms that 57/68 Act applies because there is generic bank guarantee in place, no matter if buyers ever received the individual document, or deposits weren't paid through Bankia, because those question aren't buyers' business so could not be enforce against them.
Judgement not only sentences Bankia to pay 100% deposits to several buyers (up to € 500,000), but also legal interest from payment to builder (4% per year roughly) and legal cost.
We are sure that the acceptance by the Court of this large class action suite will bring hope to all those buyers who haven't got deposit back yet.
