ROYAL DREAMS OF ALBUDEITE (GRUPO TRAMPOLIN): VALENCIA MAGISTRATES' COURT NEW JUDGEMENT ORDERS BTA INSURANCE TO REFUND DEPOSIT TO PURCHASERS

Courts are moving forward in the purchasers protection, to make sure that they could get back their savings when properties are not built or completed by the time agreed on contracts. And the new judgement from the Valencia Appeal Court is a good example.

The Court has ordered BTA Insurance to refund deposit, plus legal interest since payment to Trampolin, to several purchasers of the development in Albudeite.

BTA Insurance signed a class insurance with Trampolin in 2008, to guarantee the refund of deposits paid for properties in the Albudeite resort. When our Law Firm sued them in behalf of several buyers, the claimed that class insurance wasn't valid, as they wording stated that their liability just arises when individual insurance policies were issued. They said also the deposits were not paid into the account mentioned on the class insurance. But the Court didn't agree with them. The Appeal Court understands that lack of individual insurance policies isn't enforceable against buyers, because it was the developer and insurance company's duty to make sure that they were given. Same happens with the lack of payment into the special account mentioned on class insurance: buyers duty was to pay deposits, and Trampolin should have made sure that those deposits were paid into the right account. So the insurance company could claim liability to Trampolin, but not to buyers.

Our clients are really happy for the achievement. But the most important now is that things are finally getting better for purchasers affected by the Grupo Trampolin fiasco... 


ROYAL DREAMS OF ALBUDEITE (GRUPO TRAMPOLIN): LA AUDIENCIA PROVINCIAL DE VALENCIA CONDENA A LA ASEGURADORA BTA DRAUDIMAS A INDEMNIZAR A LOS COMPRADORES

La Justicia está dando pasos de gigante en la interpretación y aplicación de la normativa de protección de los consumidores adquirentes de vivienda en construcción, para garantizar a éstos la recuperación de las cantidades anticipadas a cuenta en caso de que las viviendas no se construyan o no se entreguen en el plazo convenido. Y buena muestra de ello es la sentencia que acaba de dictar la Audiencia Provincial de Valencia, condenando a BTA Seguros a indemnizar a varios compradores de la promoción de Albudeite con el importe correspondiente a las cantidades entregadas a Trampolín, más intereses desde el pago al promotor, y las costas.

La Audiencia Provincial entiende que la aseguradora es responsable al haber emitido un seguro colectivo para la promoción de Albudeite, aunque condicionara su validez a la entrega de una póliza individual a cada uno de los compradores, dado que la falta de entrega de dicha póliza por promotora y aseguradora no es oponible a los adquirentes de las viviendas. En idéntico sentido se pronuncia sobre la falta de ingreso de las cantidades en la denominada cuenta especial: es una obligación del promotor proceder a su ingreso en la cuenta designada en el contrato, cuyo incumplimiento en modo alguno puede redundar en perjuicio del comprador.

Nuestros clientes se siente realmente aliviados y felices con el resultado tras tantos años de incertidumbre, pero lo realmente importante es que parece que, por fin, una nueva esperanza se abre para los compradores de Trampolín.
